一、服务条款
1.1 服务说明
迈雅（Maya）船舶备件 AI 智能报价系统（以下简称"本平台"）由迈考根（深圳）科技有限公司运营，为船舶管理公司、航运公司、备件供应商及船舶工程服务商提供备件询价、报价、采购、物流追踪及单证管理等一站式数字化服务。
1.2 用户注册与账户
- 用户应提供真实、准确、完整的注册信息，包括但不限于公司名称、联系人、邮箱、电话等。
- 用户应妥善保管账号和密码，因账户信息泄露导致的损失由用户自行承担。
- 平台有权对涉嫌虚假注册的账户进行冻结或注销处理。
- 商家及服务商入驻需提交营业执照、资质证书等材料，经平台审核通过后方可正式运营。
1.3 用户行为规范
- 不得利用本平台从事任何违反中华人民共和国法律法规的活动。
- 不得发布虚假询价、恶意报价、欺诈性采购信息。
- 不得干扰平台正常运营，包括但不限于恶意攻击、爬取数据、传播病毒等。
- 不得冒用他人或他企业名义进行注册和交易。
- 用户间交易应遵循诚实信用原则，履行合同义务。
1.4 服务费用
本平台基础服务（询价、报价、订单管理）目前免费提供。平台保留对未来增值服务收取合理费用的权利，届时将提前通知用户。
1.5 知识产权
本平台的软件、界面设计、AI 模型、数据库、商标、Logo 等知识产权均归迈考根（深圳）科技有限公司所有。未经书面授权，任何人不得复制、修改、传播或用于商业用途。
1.6 服务变更与终止
- 平台有权根据运营需要调整服务内容，并提前公告。
- 用户可随时停止使用本平台服务并注销账户。
- 对于严重违反服务条款的用户，平台有权随时终止服务。
二、用户隐私保护
本平台高度重视用户隐私保护，严格遵守《中华人民共和国个人信息保护法》《中华人民共和国数据安全法》及相关法律法规。
2.1 信息收集
本平台收集以下信息：
- 注册信息：公司名称、联系人姓名、邮箱、电话、公司类型等。
- 交易信息：询价单、报价单、采购订单、物流单证等业务数据。
- 资质信息：商家营业执照编号、服务商资质证书等。
- 使用信息：登录时间、操作日志、设备信息等，用于安全审计和服务优化。
2.2 信息使用
收集的信息仅用于以下目的：
- 提供询价、报价、采购、物流等核心业务服务。
- AI 智能匹配：将询价与合适商家匹配、将工程需求与服务商匹配。
- 发送业务通知邮件（报价通知、订单状态更新、物流提醒等）。
- 平台安全防护与反欺诈。
- 服务质量改进与功能优化。
2.3 信息保护
- 用户密码采用 scrypt + 随机 salt 哈希存储，不以明文形式保存。
- 平台采用 HTTPS 加密传输，SSL 证书由 Let's Encrypt 签发。
- 数据存储于腾讯云服务器，具备企业级安全防护。
- 平台内部实行最小权限原则，仅授权人员可访问用户数据。
2.4 信息共享
除以下情形外，平台不会向第三方共享用户个人信息：
- 经用户明确同意（如询价匹配时将需求发送给对应商家）。
- 法律法规要求或行政/司法机关合法调取。
- 与合作的物流公司、货代公司共享必要的订单信息以完成交付。
2.5 用户权利
- 查询与更正：用户可随时查看和修改自己的注册信息。
- 删除：用户可申请删除账户及相关数据。
- 导出：用户可申请导出自己的业务数据。
- 撤回同意：用户可随时停止使用平台服务并要求删除个人信息。
2.6 Cookie 与本地存储
本平台使用 localStorage 存储用户登录状态和语言偏好，不使用追踪型 Cookie。用户可通过浏览器设置清除本地存储数据。
三、免责声明
⚠️ 请仔细阅读以下免责条款。注册即表示用户已知悉并同意以下内容。
3.1 平台定位
本平台为信息中介服务平台，仅提供询价、报价、订单管理等线上工具，不直接参与用户间的实际交易。平台上的备件信息、报价内容均由商家自行发布，平台不对具体商品质量、交付时效、售后服务等承担担保责任。
3.2 交易风险
- 用户间的交易纠纷（包括但不限于质量问题、交货延迟、付款争议）应由交易双方自行协商解决。
- 平台可协助提供交易记录和沟通记录作为参考，但不承担裁决义务。
- 建议用户在交易前核实对方资质，签订正式贸易合同，并选择可靠的支付和物流方式。
3.3 AI 生成内容
本平台的 AI 功能（包括智能询价解析、报价生成、替代品推荐、邮件撰写等）基于大语言模型生成，可能存在不准确或不完整之处。AI 生成的报价单、邮件等内容仅供参考，用户应在发送前进行人工审核。平台不对 AI 生成内容的准确性承担法律责任。
3.4 服务中断
因以下原因导致服务中断或数据丢失，平台不承担责任：
- 服务器故障、网络中断、电力中断等不可抗力因素。
- 定期维护、系统升级导致的服务暂停（平台将提前通知）。
- 黑客攻击、病毒入侵等第三方恶意行为。
- 用户自身操作失误或设备故障。
3.5 第三方链接
本平台可能包含指向第三方网站的链接（如 Chrome 下载、QR 码服务等），平台不对第三方网站的内容、隐私政策或服务可靠性负责。
3.6 知识产权侵权
用户上传的营业执照、产品图片、技术文档等内容，其知识产权归原权利人所有。如发现平台上存在侵权内容，请发送邮件至 info@macogenmarine.com，平台将在收到通知后及时处理。
四、法律适用与争议解决
- 本条款适用中华人民共和国法律。
- 因使用本平台产生的争议，双方应友好协商解决；协商不成的，任何一方均可向迈考根（深圳）科技有限公司所在地有管辖权的人民法院提起诉讼。

1. Terms of Service
1.1 Service Description
Maya Marine Spare Parts AI Quote System ("the Platform") is operated by MACOGEN MARINE TECHNOLOGY CO.,LTD, providing one-stop digital services including spare parts inquiry, quotation, procurement, logistics tracking, and document management for ship management companies, shipping companies, spare parts suppliers, and marine engineering service providers.
1.2 Registration & Account
- Users shall provide true, accurate, and complete registration information, including but not limited to company name, contact person, email, and phone number.
- Users shall safeguard their account credentials. The Platform is not liable for losses caused by credential leakage.
- The Platform reserves the right to freeze or cancel accounts suspected of false registration.
- Merchants and service providers must submit business licenses and qualification certificates for review before operating on the Platform.
1.3 User Conduct
- Users must not use the Platform for any activities violating the laws of the People's Republic of China.
- Users must not post false inquiries, malicious quotations, or fraudulent procurement information.
- Users must not disrupt Platform operations, including but not limited to malicious attacks, data scraping, or virus distribution.
- Users must not impersonate other individuals or companies.
- Transactions between users shall follow the principle of good faith and fulfill contractual obligations.
1.4 Service Fees
The Platform's core services (inquiry, quotation, order management) are currently free. The Platform reserves the right to charge reasonable fees for future premium services, with prior notice to users.
1.5 Intellectual Property
All intellectual property rights of the Platform's software, interface design, AI models, databases, trademarks, and logos belong to MACOGEN MARINE TECHNOLOGY CO.,LTD. No one may copy, modify, distribute, or use them for commercial purposes without written authorization.
1.6 Service Changes & Termination
- The Platform reserves the right to adjust services based on operational needs, with prior notice.
- Users may stop using the Platform and cancel their accounts at any time.
- The Platform may terminate services for users who seriously violate these Terms.
2. Privacy Policy
The Platform highly values user privacy and complies with the Personal Information Protection Law of the PRC, the Data Security Law of the PRC, and other applicable laws and regulations.
2.1 Information Collection
The Platform collects the following information:
- Registration data: Company name, contact person, email, phone, company type, etc.
- Transaction data: Inquiries, quotations, purchase orders, logistics documents, etc.
- Qualification data: Business license numbers, service provider certificates, etc.
- Usage data: Login time, operation logs, device info for security audit and service optimization.
2.2 Information Usage
Collected information is used solely for:
- Providing core business services: inquiry, quotation, procurement, logistics.
- AI smart matching: matching inquiries with suitable merchants, engineering needs with service providers.
- Sending business notification emails (quotation alerts, order status updates, logistics reminders).
- Platform security and anti-fraud measures.
- Service quality improvement and feature optimization.
2.3 Information Protection
- User passwords are hashed using scrypt + random salt, never stored in plaintext.
- The Platform uses HTTPS encrypted transmission with Let's Encrypt SSL certificates.
- Data is stored on Tencent Cloud servers with enterprise-grade security.
- Internal access follows the principle of least privilege.
2.4 Information Sharing
The Platform does not share user personal information with third parties except:
- With user's explicit consent (e.g., sending inquiry details to matched merchants).
- When required by law or requested by judicial/administrative authorities.
- Sharing necessary order information with partnered logistics/freight companies for delivery.
2.5 User Rights
- Access & Correction: Users may view and modify their registration information at any time.
- Deletion: Users may request account and data deletion.
- Export: Users may request export of their business data.
- Withdraw Consent: Users may stop using the Platform and request deletion of personal information.
2.6 Cookies & Local Storage
The Platform uses localStorage for login state and language preferences, and does not use tracking cookies. Users can clear local storage via browser settings.
3. Disclaimer
⚠️ Please read the following disclaimer carefully. By registering, users acknowledge and agree to the terms below.
3.1 Platform Role
The Platform is an information intermediary service, providing online tools for inquiry, quotation, and order management. It does not directly participate in actual transactions between users. Spare parts information and quotations are published by merchants. The Platform does not guarantee product quality, delivery timeliness, or after-sales service.
3.2 Transaction Risks
- Transaction disputes (including quality issues, delivery delays, payment disputes) shall be resolved by the parties involved.
- The Platform may assist by providing transaction and communication records for reference, but does not assume adjudication obligations.
- Users are advised to verify counterpart qualifications, sign formal trade contracts, and choose reliable payment and logistics methods before trading.
3.3 AI-Generated Content
The Platform's AI features (smart inquiry parsing, quotation generation, alternative recommendations, email drafting, etc.) are based on large language models and may contain inaccuracies. AI-generated quotations, emails, and other content are for reference only. Users should review before sending. The Platform is not legally liable for the accuracy of AI-generated content.
3.4 Service Interruption
The Platform is not liable for service interruptions or data loss caused by:
- Server failures, network outages, power outages, or other force majeure.
- Scheduled maintenance or system upgrades (with prior notice).
- Hacker attacks, virus intrusions, or other third-party malicious acts.
- User's own operational errors or device failures.
3.5 Third-Party Links
The Platform may contain links to third-party websites (e.g., Chrome download, QR code services). The Platform is not responsible for third-party website content, privacy policies, or service reliability.
3.6 Intellectual Property Infringement
Intellectual property of content uploaded by users (business licenses, product images, technical documents) belongs to the original rights holders. If infringing content is found, please email info@macogenmarine.com. The Platform will process it promptly upon notification.
4. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the People's Republic of China.
- Disputes arising from the use of the Platform shall be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the people's court having jurisdiction over MACOGEN MARINE TECHNOLOGY CO.,LTD's location.
